Terms and Conditions

These Terms and Conditions ("Terms") govern the relationship between Twin Built Carpentry and Joinery ("Twin Built," "We," "Us," or "Our") and the customer ("You" or "Your") in connection with the provision of services by Twin Built. By engaging Twin Built’s services, You agree to these Terms.
1. Scope of Work
1.1. Twin Built will provide services as outlined in the agreed quote or proposal. Any additional services not included in the initial scope will require a signed variation agreement, including adjustments to the timeline and costs.
1.2. It is Your responsibility to review and approve the scope of work before the commencement of services.
2. Quotations and Variations
2.1. All quotes are valid for 30 days from the date of issue. Quotes may be subject to adjustment due to changes in material costs or other unforeseen factors.
2.2. Any changes to the agreed scope of work must be documented and approved in writing as a variation. Variations may incur additional costs and affect the project timeline.
3. Payment Terms
3.1. A deposit of [insert percentage, e.g., 20%] of the total quote is required to confirm the booking.
3.2. Progress payments will be outlined in the quote and must be made within the specified timeframes. Final payment is due upon project completion.
3.3. Accepted payment methods include bank transfer, credit card, and [any other methods].
3.4. Late payments will incur interest at [insert interest rate, e.g., 5% per month] from the due date. Twin Built reserves the right to suspend or terminate services for overdue payments.
3.5. Ownership of materials remains with Twin Built until payment is received in full.
4. Timeline and Delays
4.1. Twin Built will provide an estimated timeline for project completion. However, delays may occur due to factors beyond Our control, including weather, supply chain disruptions, or unforeseen site conditions.
4.2. In such cases, Twin Built reserves the right to reasonable extensions without penalty.
5. Defects and Rectification
5.1. You must notify Twin Built of any defects in writing within 14 days of project completion.
5.2. Twin Built reserves the right to inspect and rectify defects within a reasonable timeframe.
5.3. Defects caused by misuse, wear and tear, or external factors beyond Our control are excluded from rectification obligations.
6. Access to Property
6.1. You must provide safe and timely access to the property for Twin Built to perform the work.
6.2. If access is restricted or the site is unsafe, delays and additional costs may apply.
6.3. Twin Built is not responsible for delays caused by Your failure to provide access.
7. Warranties and Guarantees
7.1. Twin Built guarantees workmanship for 12 months from the date of project completion.
7.2. Materials used in the project are subject to manufacturer warranties. Twin Built is not liable for manufacturer defects but will assist in claims where possible.
7.3. This warranty does not cover:
Normal wear and tear.
Damage caused by misuse or failure to maintain the work.
Issues arising from external factors beyond Twin Built’s control.
7.4. Twin Built complies with the Australian Consumer Law (ACL) and provides all mandatory guarantees.
8. Cancellations and Termination
8.1. If You cancel the project, Twin Built reserves the right to retain the deposit as a cancellation fee.
8.2. Twin Built may terminate the agreement if You breach these Terms, fail to make payments, or unreasonably delay the project.
9. Liability Limitation
9.1. Twin Built’s liability is limited to the cost of the services provided.
9.2. Twin Built is not liable for indirect, consequential, or incidental damages arising from delays, defects, or other issues unless required by law.
10. Indemnity
10.1. You agree to indemnify Twin Built against claims, damages, or liabilities arising from Your failure to comply with these Terms or provide accurate information.
11. Insurance
11.1. Twin Built maintains public liability insurance and any other necessary coverage.
11.2. You are responsible for maintaining adequate insurance for Your property during the project.
12. Force Majeure
12.1. Twin Built is not liable for delays or non-performance due to events beyond reasonable control, including but not limited to natural disasters, government restrictions, or supplier shortages.
13. Dispute Resolution
13.1. Any disputes must first be attempted to be resolved through negotiation.
13.2. If negotiation fails, the dispute will proceed to mediation or arbitration before legal action is taken.
13.3. These Terms are governed by the laws of the Australian Capital Territory (ACT).
14. Health and Safety
14.1. Twin Built complies with all applicable workplace health and safety standards.
14.2. You must notify Twin Built of any hazards on-site before work commences.
15. Intellectual Property
15.1. All plans, designs, and materials provided by Twin Built remain Our property unless otherwise agreed in writing.
15.2. Unauthorized use or reproduction of Twin Built’s intellectual property is prohibited.
16. Privacy and Confidentiality
16.1. Twin Built handles personal data in accordance with Our Privacy Policy, available at https://www.twinbuilt.com.au/privacy-policy.
16.2. We will treat Your personal and project information confidentially.
17. Changes to Terms
17.1. Twin Built reserves the right to update these Terms. Changes will be posted on Our Website and take effect immediately unless otherwise specified.
